Terms and Conditions governing Alireta's Web Services

In signing up for Alireta's Web services, you agree to comply with Alireta's Terms of Service as outlined in this document. The spirit of this policy is to ensure our customers are using our services with due regard to the rights of other Internet users and in conformity with our requirements. All references to Alireta in this document shall be interpreted to include: the Principals, Staff and Back-end Service Providers of Alireta Nigeria Limited. It is recommended that you print out a copy of this document for your reference.
If you do not agree with any part of them then you should stop using our web services immediately
Account Activation
Alireta reserves the right to reject an order, if not convinced of the validity of a subscriber e.g. unconvincing names and contact details, unverifiable information and claims. Hosting-only orders for unregistered domains are not allowed. Where payments have been made by the subscriber, refunds will be made by Alireta in line with our Refunds Policy below.
Alireta reserves the right to suspend, and where necessary terminate an activated account on the basis of the above conditions as well. Refunds will not be made by Alireta in event of a breach of any of these conditions. The spirit of this is to ensure that our services are not used for illegal purposes.
Our Liability
Alireta's services are provided on an as is, as available basis. Alireta expressly disclaims any representation or warranty that its service will be error-free, secure or uninterrupted.
In cases of outage the client's sole remedy will be a pro-rated credit based on the period difference of downtime and Alireta's promised up-time.
No oral advice or written information given by Alireta , its employees, licensors or the like, will create a warranty; nor may you rely on any such information or advice. Alireta will not be liable for any cost or damage arising either directly or indirectly caused by client's error.
By placing information on your hosting account, such information becomes available to all Internet users. Alireta has no way of limiting or restricting access to such information or protecting such information from copyright infringement. You assume total responsibility and risk for your use of Alireta's servers and the Internet. It is solely your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise provided through Alireta or on the Internet generally.
Your use of the service is at your sole risk. Alireta is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.
Alireta performs routine daily backups of all users' data. If a user experiences data loss due to their own doing, there is a fee of N2,000 per incident that requires a restore of backup to the user's account.
Illegal Use
Alireta services may be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation is prohibited.
This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorization, impersonation, deliberate mis-representation, financial scam operations [419], material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of unacceptable content or links include: pirated software, hacker programs or archives, Warez sites, MP3, and IRC bots.
In particular, Alireta has a ZER0-TOLERANCE POLICY FOR FINANCIAL SCAMMERS; and any account discovered to be used as an avenue for such activities WILL BE TERMINATED WITHOUT PRIOR NOTICE AND WITHOUT THE OPTION OF A REFUND. In addition, we will file a formal report with the Police through our Solicitors.
Alireta reserves the right to monitor any and all communications through or with our facilities.
Your Liability
You agree to reimburse us in full if we suffer any loss or damage or incur any costs because you use (or allow anyone else to use) this Site or your account/site for illegal, immoral or improper purposes.
Adult Content
Adult-oriented sites are not allowed. This includes sites that are associated with bestiality or child pornography, sites which promote hate against any group, sites of such nature will be removed immediately and you will not be refunded. This is also true for sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet, or provide links to such sites.
Security
Violations of system or network security are prohibited and may result in criminal and civil liability. Examples include but are not limited to the following: unauthorized access, use, probing, or scanning of systems security or authentication measures, data, or traffic; interference with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
You are responsible for ensuring that you use an adequate password for your account/s, and not simple passwords that can be easily cracked by hackers.
Server Resources & Limits
Any web site that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources over their allotted limits) will be given the option to either pay additional fees (which will depend on the resources required), reduce the resources used to an acceptable level, or upgrade its service to a Dedicated Server plan.
Server Limits
35% cpu and or memory for 3 minutes
250 email limit per domain per hour
50 concurrent database connections at one time
Apache threads to be open no longer then 999 seconds
Php upload limit of 50 megs
Max php session time of 300 seconds or less
In general, if your account uses server resources such that other accounts are denied service or the server is at risk
of crashing, Alireta reserves the right to suspend your account immediately without notice.
High-traffic websites are better off on a VPS or Dedicated server.
Audio/Video Files
Any audio/video files stored on an Alireta account shall be limited in size to 50% of the total disk space allotted for that particular domain's plan/web hosting account.
CGI ScriptsS
CGI script sharing with domains not hosted by Alireta is not permitted. Any CGI-scripts deemed to be adversely affecting server performance or network integrity will be shut down without prior notice.
Chat Rooms
Alireta does not allow customers to install their own chat rooms not supplied as part of the package they lease from Alireta. Some Chat rooms tend to require significant system resources and therefore cannot be permitted as an account option.
Background Running Programmes
We do not allow background-running programs. This includes any IRC related software such as bouncers and bots. In certain cases we may allow programs to run continually in the background, these are considered on a one to one basis and an extra charge will be incurred based on system resources used and operational maintenance needed.
Banned Scripts
You are free to use any scripts you wish provided they do not affect the normal operations of the server and they are not mentioned specifically below. Scripts that are commonly known for causing server disruption include large cgi-based message forums, auctions, and banner exchanges. In the event a script affects normal server and/or administrative operations, Alireta reserves the right to disable the account pending client cooperation and resolution.
Violation of indecency and obscenity laws can result in criminal penalties.
IRC
Alireta does not allow IRC or IRC bots to be operated on its servers.
UCE (Unsolicited Commerce Email) - SPAM
Spamming, the sending of unsolicited mass email from or through Alireta's server or using an email address that is maintained on a Alireta account is STRICTLY prohibited. Alireta will be the sole arbiter as to what constitutes a violation of this provision.
Customers are also in violation of this provision if they engage in spamming using the service of another ISP or IPP, but reference in the spam a web site hosted on a Alireta account.
Violators will be assessed a minimum fine of $500.00 or N75,000.00 and will face immediate SUSPENSION OR TERMINATION of account.
Server Abuse
Any attempts to undermine or cause harm to a service or customer of Alireta are strictly prohibited.
Databases
Any database stored on a Alireta account shall be limited in size to a maximum of 50% of the total disk space allotted for that particular domain's plan/web hosting account.
Fees and Payments
All payments for our services shall be made in full upfront via electronic payment systems, money transfer, bank deposit, or cheque issued to Alireta. Cheque payments will not be deemed to have taken effect on any account until such cheques are cleared.
Alireta does NOT accept cash payments for its services. Handing over cash to anyone claiming to be a staff or agent of Alireta is entirely at the Customer's risk. Alireta shall not be held liable for the consequences of any such arrangement or transaction.
AliretaPlus Subscriptions
All AliretaPlus subscriptions run from January to December each year, regardless of when the initial subscription was run. The full sum of N2,500 is required to be paid, regardless of when subscription is made during the year.
AliretaPlus subscribers cannot purchase Alireta's regular webhosting plans. They are strictly restricted to AliretaPlus plans.
AliretaPlus subscription renewals are to be effected before the 31st of December of the outgoing year. Failure to do so will attract a penalty of N1,000. Failure to pay the renewal and penalty within January of the new year will result in all the subscriber's hosting accounts being migrated from AliretaPlus to the regular hosting plans.
Non-AliretaPlus clients cannot place orders for AliretaPlus plans or have their existing hosting accounts migrated to AliretaPlus plans without first subscribing by paying the required fee.
Hosting Account Renewal
All customers are expected to maintain accurate records of payments made and renewal dates for all their web hosting accounts, and to make payments for renewal on their accounts as at when due. Alireta shall endeavour to send renewal notices to the email address on file for each account, but Alireta shall not be held liable for failure to send these notices.
Any account whose renewal is not paid for as at the due date shall be moved into a state of suspension 7 days after the expiration of previous fees. Because a suspended account still takes up server resources, a suspended account shall be billable at the ongoing hosting rate, and any fees paid for renewal/re-activation of a suspended account shall be accounted as running from the date the previous payment expired.
After 30 days from the last expiry/renewal date, accounts suspended for default in payments will be terminated and all files (including emails) deleted from our servers.
Terminated accounts will not be admitted back to our service without the payment of the fees accrued during the period of suspension prior to termination.
Domain Name Renewal
All customers are expected to maintain accurate records of payments made and renewal dates for all their domain names, and to make payments for renewal of same when due. Alireta shall endeavour to send renewal notices to the email address on file for each account, but Alireta shall not be held liable for failure to send these notices.
In line with Alireta's Courtesy Domain Renewal service, where a customer is unable to pay for the renewal of a domain name when due but desires to keep the name, the said customer may send an email to Alireta to request for Courtesy Domain Renewal, and we shall extend the registration of the domain name by one (1) year in good faith. This is to prevent loss of that domain name to cyber squatters.
If a domain is renewed by Alireta in good faith, the renewal fee payable by the customer shall be N5,000 instead of the standard domain renewal fee. Where the customer fails to pay this fee within 1 month of renewal, Alireta shall take possession of the domain name and may dispose of it in anyway it pleases, including by auctioning.
Communication between Alireta and Customers
The standard medium of communication on all matters shall be electronic mail [email], so the client shall be required to supply a valid and active email account when signing up for any of our services. All mails shall be sent to this email address on file, unless and except the Client gives notice to effect a change of that address. In exceptional circumstances as Alireta shall determine, the client may be communicated with through other media.
Actions taken by Alireta
The failure by a customer or user to meet or follow any of the above Terms of Service is grounds for account deactivation/termination. Alireta will be the sole arbiter as to what constitutes a violation of the Terms of Service. Alireta reserves the right to remove any account without prior notice.
When Alireta becomes aware of an alleged violation of its Terms of Service, Alireta will initiate an investigation. During the investigation, Alireta may restrict a customer's access in order to prevent further potentially unauthorized activity.
Depending on the severity of the violation, Alireta may, at its sole discretion, restrict, suspend, or terminate a customer's web hosting account and/or pursue other civil remedies. If such violation is a criminal offence, and Alireta will notify the appropriate law enforcement authorities of such violation.
REFUNDS FOR WEBHOSTING
Alireta has a 30-day money-back policy for its web hosting service. If the client is dissatisfied with our web hosting service and requests a refund within the 30-day period, Alireta shall refund in full the hosting fees.
Annual payment option for web hosting is a contract between Alireta and Client that the Client shall maintain the account for a minimum period of 12 months. By implication, after the initial 30-day money-back period, Alireta is not liable to issue a refund should the Client choose not to use the purchased service anymore before the 12-month period is over.
REFUNDS FOR DOMAIN NAMES
Fees for domain names registered cannot be refunded under any circumstances.
Alireta does not issue refunds for outages incurred through service disablement resulting from Terms of Use violations. Alireta customers and users agree to indemnify and hold harmless Alireta from any claims resulting from the use of our services that damages them or any other party.
Accuracy of Information
We do our best to ensure that the information provided on this Site is up to date and accurate. We would use reasonable endeavours to correct any errors or omissions as soon as practicable after they are noticed by us or we are notified of them. If you intend to rely upon any information presented on this Site, you are responsible for checking its validity and accuracy and ensuring that it meets your specific requirements.
To the extent permitted by the applicable law, we disclaim all warranties and representations (whether express or implied) as to the accuracy of any information contained in the Site.
Alireta reserves the right to add, delete, or modify any provision of its Terms of Service at any time with written notice to the customer's email address supplied during service signup.
Links to Other Sites
We are not responsible for the content, security or performance of any other web sites to which this Site has links and we do not endorse any products or services advertised on them. Once you leave our Site, you will no longer be covered by our terms and conditions or privacy and security policies.
Jurisdiction
The products or services on this Site are intended for use by persons over the age of 18 and our terms and conditions are drafted accordingly. The parties agree that the laws of the Federal Republic of Nigeria will apply to these terms and conditions and that any disputes will be subject to the jurisdiction of the Nigerian Courts.
General
If any of the clauses of these terms and conditions is found to be unlawful, invalid or unenforceable, that provision shall be deemed to be deleted and the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected. We reserve the right to transfer our rights, duties and responsibilities set out in these terms and conditions to another party.
We reserve the right to amend the contents of the Site, these terms and conditions or our security and privacy policy from time to time. Please review this document regularly.
If you do not agree with any part of our Terms and Conditions, you are ineligible to purchase any web service from us. By proceeding to make payment for any of our web services, you affirm that you are bound by all the terms stated on this page.
